THE RELATIVISM OF LAW & JUSTICE - Free E-Book inclusive
No doubt, I am sure, you need and deserves justice. Law and Justice are subjects so closely intertwined that separating the duo could be herculean. It is often said, the the ends meet of Law is Justice meaning that the essence of having laws is to achieve justice. Similarly, it is trite that justice delayed is justice denied, and on the other way round, justice rushed is also justice denied. In the Nigeria context, the notion of Justice differs. What is Justice to Mr A will be unjust to Mr B.
When an accused person is brought to court by the prosecution, to the accused justice is best served if the Judge was not biased in the way and manner of handling the accused's case, as the accused will anticipate freedom in the long run. To the prosecutor, justice is achieved when the accused person is convicted and punished fro the crime(s) committed.
Again, their is the syndrome of Jungle Justice is Nigeria. Offenders on a broad day light are sometimes roasted to death by angry mobs who want instant justice and would not like to risk surrendering the offender to law enforcement agents.
What about other forms of justice?
There are plethora of species of justice. These include:
Natural Justice - So closely aligned with the doctrine of Karma.
Criminal Justice - Applicable in Criminology and Criminal Justice Systems
Distributive Justice - Sometimes underscore by the notion of equality of rights and duties
Retributive Justice - Apportionment of blame
Social Justice - Social liberation, protection and enhancement of civil liberties, civil rights, ecosoc rights
Moral justice - based on norms and ethics of a given society
Poetic Justice - can be found in the literary world
Vindictive Justice - similar to the American Realism and many more
We are unable to explore in details what justice entails here, but given the current circumstances in the country, the anti graft agencies saga, the war against corruption, and the recent opinion of President Buhari that his main headache is the Nigerian Judiciary, it worths the efforts to talk more on what Justice is all about especially as far the Nigerian Judiciary is concerned.
Law Jurists through its research effort would therefore provide you a book written by an eminent jurists John Rawls titled " A Theory of Justice" for your personal and educational use. The book is well recommended and its over 500 pages. Click here to download yours.
